Child visitation, custody, and support

In the absence of an agreement between the parents, Child custody is determined by the Court according to the best interests of the child. However, New York courts have held against awarding joint custody where the relationship of the parents is so embittered that they cannot set aside their difference for the sake of the child. Child support is calculated based on the combined income of the parents, payable by the non-custodial parent to the custodial parent:

17 percent for 1 child
25 percent for 2 children
29 percent for 3 children
31 percent for 4 children
No less than 35 percent for 5 or more children
